Kimodameshi Online — Terms of Service

These terms apply when you use the following, provided by Panda (“we”, “us”; パン田 in Japanese), together the “Service”. By using the Service, you agree to these terms.

  • The game Kimodameshi Online (full version and demo; the “Game”)
  • The official website (https://kimodameshi-online.com)
  • The official Discord server and its moderation bot
  • The Discord app “Kimodameshi Online”

1. Other rules

  1. Please also follow the terms of the outside services the Service uses, such as Steam, Epic Online Services, and Discord.
  2. Purchases and refunds follow Steam's rules.
  3. For fan works and streaming, follow the “Fan works guidelines” page and the “For streamers” section of the top page on the official website. On the official Discord server, also follow the server's rules channel.

2. Who can use the Service

You must be 13 or older. If you're under 18, get a parent or guardian's permission first.

3. What you must not do

When using the Service, don't:

  1. Break the law, or violate others' rights (copyright, likeness, privacy, and so on)
  2. Harass, insult, discriminate against, or threaten anyone
  3. Post personal information (real names, addresses, phone numbers, contact details, and so on), yours or anyone else's, or try to get it from others
  4. Pretend to be us or someone else
  5. Put sexual or discriminatory content, or others' work used without permission, into names, chat, drawings, haunted house sets, or the Workshop
  6. Use cheats or mods to ruin other players' games or gain an unfair advantage
  7. Attack the network or servers, or access anything without permission
  8. Use or distribute data extracted from the game files (3D models, images, sounds, fonts, and so on)
  9. Advertise, solicit, or spam
  10. Do anything else similar that bothers other people

4. Interacting with other players

  1. Chat and voice reach the people in the same room. The player who opened the room can remove people from the room or block them.
  2. Please settle disputes between players among yourselves.

5. What you make

  1. You keep the rights to what you make, such as your player name, chat messages, drawings, haunted house sets, and Workshop posts.
  2. You let us use them for free to run and promote the Service (including featuring them on the official website, social media, and videos).
  3. Steam's terms also apply to Workshop posts. Other players can download your posts, play them, and keep them. If you choose “Allow editing” when posting, other players can also edit and repost them. Even then, the original creator's name stays. If you delete a post, copies that others have already downloaded stay with them.
  4. Don't post anything that violates someone else's rights.

6. Our rights

The text, art, sound, software, and other content of the game and the official website belong to us or to the original rights holders. You can't use them without permission, except as the “Fan works guidelines” page allows.

7. If you break these terms

If we find a violation, we may do the following, sometimes without notice:

  • Remove Workshop posts from listings or ban them, or stop you from posting for a period of time
  • On the official Discord server, delete messages, time you out, or remove you from the server
  • Take action as the law allows

8. Changes to the Service, and ending it

  1. We may change, pause, or end the Service.
  2. Online play depends on Steam and Epic Online Services. If they stop working, you may not be able to play.
  3. If we end the Service, we'll announce it on the official website as early as we can.

9. Our responsibility

  1. We don't promise that the Service is free of bugs, that it will keep running, or that it will suit your purposes.
  2. Unless we acted intentionally or negligently, we're not responsible for damage arising from:
    • Trouble with other players (chat, voice, drawings, names, removal from the room or blocking by the player who opened the room, and so on)
    • Outages, changes, or shutdowns of outside services such as Steam, Epic Online Services, Discord, Cloudflare, and Google, or how they handle your accounts
    • Your internet connection, or problems with your device, operating system, or other software
    • Loss of or damage to data saved on your device or in Steam Cloud (settings, haunted house sets, drawings, and so on)
    • The content of other people's Workshop posts, or posts you downloaded being removed or banned
    • The content of other websites linked from the official website
    • Natural disasters, power outages, and other events we can't prevent
    • Actions we take under Section 7
  3. For damage caused by our intent or gross negligence, we're responsible as the law requires.
  4. For damage caused by our ordinary (non-gross) negligence, we're responsible only for the ordinary, direct damage, up to the amount you paid for the Game. This limit applies only to ordinary negligence.

10. Changes to these terms

We may change these terms. Before a change takes effect, we'll announce what's changing and the date it takes effect on the official website and the official Discord server.

11. Language

These terms are published in 8 languages. If the versions differ, the Japanese version takes precedence.
